Free trade zones are designated areas or regimes that offer customs, tax, or administrative incentives to facilitate commerce. They can support warehousing, manufacturing, processing, distribution, and re-export. Their legitimate economic purpose is distinct from the illicit-finance risks that can arise when ownership information, supervision, or coordination is weak. The Financial Action Task Force’s 2010 study examines that combination: trade facilitation can create economic benefits while also providing opportunities for laundering, smuggling, and commercial fraud.

Different kinds of zones
The term covers a range of arrangements rather than a single worldwide legal model. FATF distinguishes general-purpose free trade zones, export-processing areas, freeports, special economic zones, and other schemes. Some focus on storage and transshipment, while others include manufacturing or a wider range of services. Being treated as outside customs territory for specified duties and taxes does not mean being outside the law or outside the country. The applicable rules and authorities differ by jurisdiction and zone.

Where vulnerabilities arise
FATF identified gaps where anti-money-laundering requirements did not apply to zone businesses in the same way as to other domestic activity, or where nonfinancial trade businesses fell outside conventional financial-sector rules. Heavy cash use could compound the problem by reducing the audit trail. These are descriptions of vulnerabilities, not findings that every zone or merchant exploited them. The report repeatedly emphasizes variation in operators, regulators, and requirements.

Repacking, relabeling, storage, and transshipment are ordinary commercial functions, but they can also interrupt the traceability of a shipment. FATF described risks where customs intervention was limited, authority was unclear, or company-formation procedures collected little information about beneficial owners. In such circumstances, investigators may struggle to establish who controlled a business and how goods moved through it. The underlying problem is the loss of reliable information linking the company, shipment, payment, and final destination.

Information systems can create another gap. FATF’s questionnaire found that zone administrations and customs authorities often used separate mixtures of paper and electronic records, with limited integration. This made it harder to compare incoming and outgoing shipments or analyze patterns across ports and businesses. The study called attention to operational cooperation among customs, zone authorities, financial intelligence units, and other agencies. The issue is not simply whether records exist, but whether they can be connected and used.

Trade-based laundering
The Kings Cross case in FATF’s report involved a clothing wholesaler in Curaçao’s free zone that became a currency exchanger for narcotics traffickers. The business bought goods from Asia and sold much of its stock to Venezuelan retailers facing difficulties obtaining dollars. The account describes payments in bolivars through employee-named accounts and the receipt of cash drug proceeds in Curaçao. Legitimate merchandise and retail demand formed part of the mechanism through which illicit funds were exchanged and presented as trade receipts.

According to the case study, the business’s books omitted the Curaçao bank accounts, and the operators earned commissions on currency dealings. FATF reported eleven arrests and confiscation of currency, real estate, and vehicles. The example demonstrates a commercial enterprise performing an illicit financial function; it does not require the traded clothing itself to be contraband. The distinction helps explain why reviewing a shipment without examining its financing may leave the laundering mechanism unseen.

Counterfeit goods and financing
FATF also identifies vulnerabilities involving cigarettes, alcohol, luxury goods, and intellectual-property violations, particularly where repackaging obscures origin or taxes are avoided. Gil Riza’s 2023 INSS study examines counterfeit goods as one component of Hezbollah-related criminal financing, while stating that this was not the organization’s main income source. The two analyses concern related trade risks, but Riza’s wider account does not establish that every counterfeit-goods activity he discusses occurred in a free trade zone.

Hezbollah-related allegations
FinCEN’s May 2024 advisory stated that Hezbollah financiers used free trade zones and weak regulatory environments to establish import-export companies facilitating trade-based laundering. It named the Tri-Border Area and zones in Chile and Panama as areas of concern and described the use of relatives as company owners. These are attributed government assessments about particular networks and mechanisms. They do not establish that ordinary diaspora trade, all businesses in the named places, or every family-owned company is part of those networks.

Controls and variation
Country reporting illustrates that zone regulation is not uniform. The 2022 International Narcotics Control Strategy Report described Aruba’s zone-management integrity system, review of companies with zone status, and restrictions on financial services within its zones. This supplies a counterpoint to descriptions of weakly supervised settings. A useful comparison asks what licensing, ownership, customs, and reporting arrangements apply to the particular zone, rather than assuming that the same weaknesses exist everywhere the label free zone is used.

Assessing a zone
The policy challenge is to preserve efficient trade while maintaining usable information and effective jurisdiction. FATF’s proposals emphasize ownership transparency, customs oversight, coordination, and attention to the risks of goods arriving from zones. GAO’s later work places free zones within the wider problem of Trade-based money laundering and cross-agency information sharing. The evidence supports examining concrete controls and transactions, rather than using a zone’s status as a substitute for investigating the actors and conduct involved.
