Section 311 of the USA PATRIOT Act is a financial-protection authority that permits the United States Treasury to identify a foreign jurisdiction, financial institution, class of transactions, or type of account as a primary money laundering concern and impose special measures. Codified at 31 U.S.C. §5318A, it operates through the Bank Secrecy Act framework. It is especially significant in cross-border cases because restrictions on United States financial institutions can affect a foreign institution’s access to correspondent banking.

Five special measures
Treasury’s 2013 explanation divides the available measures into five categories. The first requires records and reports concerning specified transactions. The second concerns beneficial ownership. The third and fourth require information about customers using payable-through and correspondent accounts. The fifth permits prohibiting, or imposing conditions on, opening or maintaining such accounts. The graduated design matters: Section 311 is not synonymous with the most restrictive measure, and an information-gathering measure can precede a proposed account prohibition.

Procedure and distinctions
A finding, a proposed rule, and a final rule are different stages. Treasury’s fact sheet explains that the fifth special measure requires a regulation, while the first four can initially be imposed by order in the circumstances described there. A proposed rule normally opens a notice-and-comment process; it can later be finalized, withdrawn, or left pending. The announcement of a finding can itself influence private financial institutions, but that commercial reaction should not be represented as the legal adoption of a final rule.

The authority requires consideration of statutory factors and consultation with other agencies. The Lebanese Canadian Bank notice described consideration of legitimate business, the usefulness of the measure, burdens on financial institutions, and effects on national security and foreign policy. Section 311 also differs from OFAC blocking: it is directed at specified financial access and information requirements, rather than automatically transferring or immobilizing every asset of the named institution. A separate sanctions action or forfeiture case can accompany it.

Lebanese Canadian Bank
In February 2011, FinCEN identified Lebanese Canadian Bank as a primary money laundering concern and proposed the fifth special measure. The government alleged that the bank facilitated a network moving narcotics proceeds and that Hezbollah benefited from the activity. These allegations linked the bank to a wider investigation involving Ayman Joumaa, exchange houses, used-car purchases in the United States, and sales in West Africa. They were administrative findings and allegations, not a criminal judgment against the bank.

The bank denied wrongdoing and management complicity. Its later civil settlement expressly preserved its position that it had contested the allegations and settled to terminate litigation and facilitate completion of its asset sale. The sale to Société Générale de Banque au Liban and the separate United States forfeiture proceedings changed the institution’s circumstances. These developments are part of the history of the Section 311 action but arose through different legal processes.

FinCEN withdrew the proposed rule in October 2015 after the bank had ceased banking operations, entered liquidation, and lost its banking license. The 2011 proposal therefore should not be described as a permanent final Section 311 prohibition. Equally, withdrawal because the institution no longer operated was not a finding that the earlier allegations were false. The sequence shows why the status and reason for a regulatory action are as important as its initial announcement.

Exchange houses and adaptation
In April 2013, Treasury identified Kassem Rmeiti & Co. and Halawi Exchange as primary money laundering concerns. Treasury presented these as its first Section 311 actions against nonbank financial institutions and described alleged movement of activity toward exchange houses following pressure on Lebanese Canadian Bank. The actions included information demands and proposed restrictions. They illustrate the authority’s capacity to follow a financial function across different kinds of intermediaries rather than being limited to conventional banks.

The Rmeiti and Halawi notices linked their concerns to alleged laundering networks operating across Europe, Africa, and Lebanon. The notices discussed United States car dealers and exporters associated with the Joumaa investigation, but such references do not establish liability for every customer or business using the same trade corridor. Reading the notices together with the civil case distinguishes a claimed financial relationship from the adjudication of a particular person’s conduct.

Broader uses
The authority is not limited to Hezbollah-related cases. Treasury’s 2024 National Terrorist Financing Risk Assessment discussed FinCEN’s October 2023 proposal concerning international convertible virtual currency mixing as a class of transactions. That example shows how Section 311 can address a type of financial activity rather than a named bank. It also reinforces the need to identify a measure as proposed when discussing the assessment’s historical account, instead of converting a proposal into a completed rule.

Place in financial investigations
A 2020 Washington Institute discussion hosted by INSS described DEA investigations that combined financial-network analysis, sanctions, and prosecutions. Lebanese Canadian Bank was among its examples, while the speaker emphasized that investigators could encounter members, supporters, and unwitting participants with different roles. Section 311 belongs within that wider set of tools: it can disrupt access and produce information, while criminal guilt, forfeiture, and later institutional outcomes require their own evidence and procedures.

Financial adaptation
An INSS analysis of Hezbollah’s global financial network described the expansion of Al-Qard al-Hassan despite sanctions imposed in 2007 and the role of commercial intermediaries and informal transfers in maintaining financial activity. It also stressed that most diaspora economic activity is legitimate. This analysis places formal financial restrictions within a wider system of adaptation; it does not establish the independent effect of this particular legal authority.
