Siavosh Henareh was convicted in the United States of conspiring to import heroin following an international undercover investigation. A jury found him guilty in November 2012, and he received a 210-month prison sentence in March 2013, affirmed on appeal in April 2014. Associated investigations produced Hezbollah-related material-support and missile cases against Cetin Aksu and Bachar Wehbe. Henareh’s conviction concerned the heroin conspiracy, rather than those defendants’ separate offences.

Investigation and contacts
The Justice Department described an investigation that developed through more than thirty meetings beginning in June 2010. Henareh met confidential sources and potential suppliers in Turkey, Romania and Greece. The confidential sources were acting for the Drug Enforcement Administration. They presented themselves as participants in an international heroin transaction and described the United States as the intended market. The contacts created a recorded sequence of introductions, discussions and practical preparations. Henareh’s role in that sequence, rather than a general claim about his political sympathies, became the basis of the narcotics prosecution. The later appeal examined whether the evidence established his knowledge of the proposed American destination.

A co-conspirator supplied a one-kilogram sample of heroin in Bucharest in April 2011, according to the prosecution’s account. The sample allowed the participants to assess a product before the proposed larger transaction. Its evidentiary significance was therefore different from that of the subsequent negotiations: it concerned an actual sample within an operation, while the larger quantity remained the subject of an intended purchase. The public announcements describe approximately 189 kilograms in the later negotiation. They do not establish that all 189 kilograms were delivered to an American buyer. The sample and the proposed shipment should be identified separately when describing the scale of the case.

The Bucharest payment meeting
The planned heroin purchase involved approximately three million euros. The government said Henareh offered his home as the meeting location and helped verify and count the money. Romanian police arrested him in Bucharest on 25 July 2011. These preparations gave the prosecution evidence of participation beyond an introduction between other people: a location, a proposed quantity, a price and involvement in the payment process. The money was associated with the heroin transaction described by the investigators. It was not identified as a completed transfer to Hezbollah. The intervention also means the proposed commercial outcome cannot simply be narrated as though the whole intended transaction occurred.

The investigation’s weapons strand involved Aksu and Wehbe negotiating with undercover participants. The Justice Department alleged that they sought weapons, including anti-aircraft missiles and rifles, for Hezbollah. Wehbe was reported to have described instructions from the organization. Aksu participated in both the heroin and weapons conspiracies, connecting two strands that might otherwise appear separate. Henareh’s heroin dealings and the weapons negotiations therefore belonged to an overlapping investigation with some shared participants. The overlap does not make every statement by Aksu or Wehbe a statement by Henareh, or every charge against them part of his judgment. The distribution of charges provides the necessary individual detail.

The weapons agreement
On 13 June 2011, Aksu and Wehbe signed an agreement in Kuala Lumpur for a weapons purchase valued at approximately $9.5 million. The government described a down payment of about $100,000, including a $50,000 wire into an undercover account. These were dollar amounts attached to the weapons agreement. The three million euros discussed in Bucharest concerned heroin, while the one-kilogram sample described the product examined earlier. The reviewed public record does not trace the weapons down payment to proceeds of a completed sale of that heroin. The connection rests on the participants, their negotiations and the purpose they expressed, not on an established identity between the separate sums.

Henareh and Aksu were arrested in Romania, while Wehbe was detained in the Maldives. Henareh and Aksu were extradited to New York on 17 November 2011, bringing the multinational investigation into the Southern District of New York. The July arrests and November transfer were separate stages. DOJ’s announcement described the charges awaiting them; the subsequent trial and pleas determined the different criminal outcomes. The extradition announcement identified Henareh as a 57-year-old Iranian citizen and Aksu as a 49-year-old Turkish citizen.

Charges and separate dispositions
Henareh and Aksu faced the heroin-importation conspiracy charge. The material-support and missile-conspiracy counts concerned Aksu and Wehbe. Wehbe pleaded guilty in November 2011 to material-support and missile conspiracies and obstruction of justice. Aksu pleaded guilty in August 2012 to the heroin, material-support and missile conspiracies and false declarations before a federal court. Henareh instead contested the narcotics accusation at trial. The different dispositions are central to an accurate biographical entry: participation in one investigation did not produce identical admissions or findings for all three defendants. The Hezbollah-related pleas are part of the surrounding case history, while Henareh’s own trial and appeal determine the description of his conviction.

Trial and sentence
A jury convicted Henareh on 27 November 2012. The following day, the Justice Department announced the verdict on the heroin conspiracy. Judge Jed Rakoff later imposed 210 months in prison and five years of supervised release. The sentencing announcement was issued on 20 March 2013; the appellate order identifies a written judgment dated 25 March. Those dates refer to different records in the progression of the case. The announced sentence was an imposed punishment, unlike the statutory maximum that may appear in an earlier charging announcement. It was also Henareh’s sentence alone: the future sentencing dates listed for his co-defendants in the same announcement do not establish their eventual punishments. The sentence also included a $100 special assessment.

Henareh challenged the sufficiency of the evidence that he knew the heroin was intended for the United States. The Second Circuit’s 25 April 2014 summary order addressed that issue by identifying recorded meetings in January and February 2011. According to the order, confidential sources explicitly discussed the American destination with him. The court also referred to testimony from a former co-conspirator and concluded that the evidence supported the jury’s verdict. This was a judicial assessment of a contested element of the drug offense. It provides a more precise explanation for the conviction than an account that merely repeats the international scope of the investigation or the prosecution’s characterization of the defendants.

Other issues on appeal
The Second Circuit rejected Henareh’s challenges concerning conscious avoidance, cross-examination and the sentence, affirming his judgment in a nonprecedential summary order. The ruling resolved his appeal and did not alter the separate offenses admitted by his co-defendants.

Defense and appellate review
Henareh testified that he had not participated in the conspiracy and did not know the drugs were intended for the United States. The appellate court held that this denial made a conscious-avoidance instruction appropriate. It also noted that his trial counsel had acknowledged the instruction’s suitability and had not preserved an objection. Reviewing for plain error, the court found none.

The court also upheld restrictions on questioning Ayyaz Baluch about an unrelated detention by the Pakistani military in the late 1990s. Baluch testified about international heroin-trafficking practices and had not investigated Henareh. The court considered the proposed questioning marginally relevant; this general-practices witness was distinct from the former co-conspirator whose testimony supported the account of Henareh’s participation.

Henareh’s 210-month sentence was below the advisory Guidelines range of 292–365 months. The appellate panel found that Judge Rakoff had considered the required sentencing factors and explained the reduction. It rejected both the procedural and substantive objections to the sentence.

Other issues on appeal
Hezbollah enters this record through the weapons negotiations and the offenses admitted by Aksu and Wehbe. The confidential sources also represented that drug profits would help finance weapons purchases. This is a documented investigative connection between a narcotics scheme and a proposed organizational beneficiary. It differs from proof that a completed heroin sale generated a payment received by Hezbollah. The undercover participants were acting for investigators, and the reviewed accounts do not establish a completed delivery of the proposed weapons. The case consequently supports a specific description of intended transactions, admitted conspiracies and individual conduct, while the actual organizational receipt of heroin profits remains unestablished in the materials reviewed.

The July 2011 Justice Department announcement covered more than one operation. A separate investigation involved Taza Gul and alleged Taliban-related activity. It should not be merged with the Henareh, Aksu and Wehbe case because it appeared in the same announcement. The heroin-to-weapons investigation discussed here involved its own meetings, sample, negotiations and arrests. Combining all of the announcement’s allegations would create a broader scheme that the document itself did not describe. The individual entry therefore follows the Henareh-related section and the later records naming his prosecution, rather than importing facts from the separate operation.

Research interpretation
Sami Kronenfeld and Yoel Guzansky’s September 2013 INSS analysis identified potential income and access to criminal logistical services as reasons militant organizations engage with drug markets. The Henareh investigation illustrates the importance of distinguishing a proposed financing purpose from completed organizational receipt. Here, sources working for the DEA presented the weapons-financing purpose, while the defendants’ individual conduct led to different convictions. The conceptual model does not establish Iranian state direction from Henareh’s nationality or convert his heroin conviction into a material-support conviction.

Place in the documented record
Henareh’s case moved from negotiations and a heroin sample to arrest, extradition, a jury conviction and appellate review. Contacts within the investigation overlapped with a Hezbollah-related weapons conspiracy, but the associated material-support pleas belonged to Aksu and Wehbe. The historical sequence establishes Henareh’s heroin conviction and unsuccessful appeal without changing his offense to match those of his co-defendants or certifying his present custody.
